For customers who contract with Marilyn’s Musings for a custom design that requires digitizing, the digitized design will remain the property of Marilyn’s Musings. It is understood that the digitizing fee is for labor, not the finished software design. If a customer wants the DST file, it must be purchased from Marilyn’s Musings.

If a customer purchases an embroidery design from a third party and wants it embroidered by Marilyn’s Musings, the embroidery design software remains the property of the customer and may not be used by Marilyn’s Musings for any other customer without permission. If the customer wants the design returned, it will be relinquished only to the customer who provided it. It is understood that Marilyn’s Musings cannot use the design after it is returned to the customer.

If a customer purchases an embroidery design from a third party and provides it to Marilyn’s Musings as an element in a design altered in any way by Marilyn’s Musings, the altered design is owned by Marilyn’s Musings. If a customer wants the altered design, it must be purchased from Marilyn’s Musings.
